qualifying foreign government

(1) Definitions .— In this subsection— (A) the term “qualifying foreign government” means a foreign government— (i) with which the United States has an executive agreement that has entered into force under section 2523; and (ii) the laws of which provide to electronic communication service providers and remote computing service providers substantive and procedural opportunities similar to those provided under paragraphs (2) and (5); and (B) the term “United States person” has the meaning given the term in section 2523.
